Upshur County District Clerk’s Office

NIcole Hernandez and her new group of clerks all really on the ball and a step above the old system that was in place. They are all a joy to speak with and know what they are doing.

I had to pay a jury appointed court fine of $5000 the people at the county clerks office did not know how to process that payment. in fact they stated that they were not there to collect that type of payment. They sent me to the district attorney's office to make my payment and the district attorney's office Informed me that the clerk's office was the only place that accepted payments. I had to stay in the office for 2 hours while they tried to figure out how to accept $5000 from me. They called 7 different people including off duty employees and the district attorney Billy Byrd himself trying to figure out how to take my money. I was sent back-and-forth between the county clerk's office and the district attorney's office four different times. They finally figured it outBut they wanted to charge me a fee of $200 just to make the payment with my bank debit card. They refused to set up a payment plan. They told me that I could pay whatever and when ever I wanted on my fine but could not tell me if a warrant for my arrest would be issued if my payment wasn't enough or on a certain date. They told me that the county clerk's office had nothing to do with warrants but the district attorney's office told me that that office is the office that issues a warrant for past due fines. . . I went a round Gilmer and acquired $5000 worth of money orders to pay on my fine and I returned to the county clerk's office at 3:57 p.m.. The website and the automated phone service for the clerk's office stated that their hours of operation were from 8:00 a.m. until 5:00 p.m.. However at 3:57 p.m. when I returned to The Clerk's office to pay my fine they had already closed the office and left for the day. I don't live anywhere near Gilmer and I was able to acquire a one time ride up there to take care of this business and because of their incompetence I was unable to do so.
