Judge Macon was filling in for Judge Egan over in Midlothian for Small Claims Court and I was not informed. Judge Macon stated that on an FM road that a person driving or hauling any type of farm has the right of way no matter what. My case was the person that came over into my lane by at least 2.5 feet and clipped my mirror causing $1,200.00 in damages was found not liable. I asked Judge Macon if they take up both lanes and you have nowhere to go, do they still have the right of way and he said yes. I had no place to go as there was steel guardrail on my side and the person hauling the farm equipment. I guess this is news to me but be aware of that as a person hauling farm equipment can take up the whole road and run you off and that apparently is totally legal according to Judge Macon.

Slow Moving Vehicle Emblem
(a) Slow-moving vehicle is defined as a motor vehicle designed to operate at a maximum speed of 25
miles per hour or less; or a vehicle, implement of husbandry, or machinery, including road
construction machinery, that is towed by: an animal; or a motor vehicle designed to operate at
a maximum speed of 25 miles per hour or less.
(b) Slow-moving-vehicle emblem means a triangular emblem that conforms to standards and
specifications adopted by the director under Section 547.104 relating to color, size, and mounting
position of a slow-moving-vehicle emblem.
(c) The slow moving vehicle emblem must be mounted (base down) from 3 to 5 feet above the surface
of the road. It must be maintained in a clean, reflective condition.
(d) If a motor vehicle displaying a slow-moving emblem tows machinery, including an implement of
husbandry, and the visibility of the emblem is not obstructed, the towed unit is not required
to display a slow moving-vehicle emblem.

Right of Way

(a) Operators of vehicles driving more slowly than the normal speed of other vehicles must drive in the
right hand lane or as close as practicable to the right hand edge of the roadway.

Operators moving in the opposite direction shall move to the right and yield at least one-half of the roadway to
the other vehicle.

Their service is just ridiculous. Out of all the JP Courts that I’ve been in and filed eviction through, none of them have been more strict and stubborn.
