The Overseas Pakistanis Justice Crisis, 25 July 2023

In a shocking development, a crisis has emerged in the Pakistani justice system, concerning the rights of overseas Pakistanis. According to court staff sources, the Vice President of the Bar allegedly attempted to manipulate justice by sending representatives to lock and key the Court of Naila Naseer Khakwani, Civil Judge 1st Class/Overseas Trial Court in Lahore. The Vice President aimed to secure a non-compliant judgment in favor of his client, potentially jeopardizing justice for the defendants.

However, the Honorable Judge Naseer Khakwani, known for his integrity and commitment to the rule of law, declined to entertain such unethical practices, standing firm in upholding justice and fairness. The proceedings have now been referred to the superior court for further review and scrutiny.

This incident has occurred amidst the observance of Ashura 9-10 Muharram and the summer holidays, taking place from 1st August 2023 to 31st August 2023, adding to concerns about the timely resolution of justice-related matters.

Overseas Pakistanis, who are already grappling with numerous challenges, are significantly affected by this crisis. Their hardships include illegal possession of their properties in Punjab and threats thereof, inordinate delays in decisions on their cases, frauds related to properties they have purchased, and hurdles in pursuing court cases from abroad.

Adding to the complexity of the situation, it has come to light that Pakistan is a top recipient of UK bilateral aid, receiving a substantial amount of 305 million pounds. Part of this aid is allocated to the Pakistan judiciary to support judicial reforms. However, the utilization of overseas Pakistani tax money in funding judicial reforms requires scrutiny and accountability, as allegations of misappropriation have arisen.

Notably, the UK-Pakistan Justice and Accountability Partnership was established in 2018 to address such challenges. The partnership aims to enhance access to justice, promote accountability, and strengthen the rule of law in both nations. It includes initiatives for legal reforms, capacity building, and the use of technology to improve the justice system. Adequate funding and support are provided by the UK government and international organizations to ensure the success of these initiatives.

As the crisis unfolds, there is a growing demand for transparency and accountability in the justice system, especially concerning the welfare and rights of overseas Pakistanis. The collaboration between the UK and Pakistan under the Justice and Accountability Partnership serves as a crucial step towards addressing systemic issues and promoting justice for all citizens.
