Real Estate One

My experience with Real Estate One Evart has been a nightmare with so many untruths you would think that this was between two political parties. Theresa Simmer at Real Estate One represented both the Buyer and the Seller (our first mistake). Secondly, she said that the Seller's needed to stay in the property 30 days after close of escrow (since they were older and needed the funds to purchase another property, we understood and agreed to no rent-our second mistake). The morning we got there, there was live wires in the garage, items missing that were going to stay, trash, debris, master bedroom blind broken, burnt tree by the backyard fire pit, and I could go on and on. In the contract, the Seller was to maintain, until they vacated and we did a walk-thru. We contacted Theresa Simmer the first day we got there, Tuesday May 16th as she wanted here Broker Heather Vallad to come with her to discuss the issues. They were not able to come out to look at the property with us until Friday May 19th. Heather took some pictures and they would get back to us. There was never a walk-thru done by the agent/broker as per Heather Vallad, because of the way it all happened, they did not do one (To make this a short version, the Seller's choose to do nothing and it was not their problem). As per the contract, the Seller's were to maintain the property until vacated and a walk-thru. Heather Vallad stated that because of them staying after close of escrow, that we had to take the property "AS IS" and not as per the contract. Theresa Simmer and Heather Vallad were witnesses for the Sellers. I tried to attached a portion of the contract which showed that we were to do a walk thru after the Seller vacated but was unable to. Some pictures taken by Heather Vallad, the Broker and some by us. We were told by the Seller's attorney, that the Seller's would give us $2.00 to pay to dump the garbage. Theresa Simmer represented and received compensated to represent both Seller and Buyer. I don't know Michigan laws, however, in most states, representing both Buyer and Seller assumes a lot of responsibility on the Agent/Broker. All of the issues were blamed on us, even though we called to report the issues the day we got there. This is a much bigger, time consuming, upsetting mess, however, I hope this provides some insight into the parties of Real Estate One that we dealt with. All I can say is Seller/Buyer BEWARE if dealing with the parties referenced herein at Real Estate One Evart.
